General Rental Terms and Conditions for Trysil Skishop AS

These terms apply between Trysil Skishop AS (hereinafter referred to as the "Lessor") and the individual or entity (hereinafter referred to as the "Lessee") who enters into an agreement to rent equipment from the Lessor, either personally or on behalf of a third party.

2. Agreement Entry

2.1 Confirmation of Booking

The Lessee is responsible for ensuring that all information in the booking confirmation is correct. The agreement is considered binding when the Lessor has confirmed the booking and full payment has been received, provided the equipment is available according to the agreement.

2.2 Acceptance of Terms

By completing the booking, the Lessee confirms that he/she has read, understood, and accepted these rental terms and conditions.


3. Definitions

  • Rental Start: The date and time the equipment is agreed to be available for the Lessee.
  • Rental Equipment: All equipment rented out by the Lessor, including but not limited to bikes, skis, snowboards, poles, helmets, bindings, and protective gear.
  • Cancellation Fee: Any fees incurred upon cancellation of the rental.
  • Nighttime: From 11:00 PM to 6:00 AM.
  • Daytime: From 6:00 AM to 11:00 PM.
  • Children: Persons up to and including 6 years old.
  • Youth: Persons from 7 up to and including 17 years old.

4. Payment

4.1 Payment Terms

Full payment for the rental period must be made at the time of booking unless otherwise agreed in writing. For payments from abroad, the Lessee is responsible for any transaction costs. The Lessor must receive the agreed amount in Norwegian currency (NOK) as specified in the confirmation.

4.2 Deposit

The Lessor does not require a deposit for rentals.


5. Cancellation and Changes

5.1 Cancellation Policy

  • More than 7 days before rental start: The Lessor retains 10% of the paid amount, minimum 350 NOK, plus any currency fees.
  • Within 7 days before rental start: The Lessor retains 100% of the rental cost.
  • Exceptions: In cases of unforeseen events documented with a medical certificate or in the event of natural disasters, the Lessor will offer a refund or rebooking.

5.2 Force Majeure and Special Cases

In cases of force majeure (e.g., natural disasters, travel restrictions), the Lessee may be offered a partial refund, full refund, or rescheduling of the rental period, depending on the situation.

5.3 Changes to Booking

Changes to the booking can be made by agreement with the Lessor and may incur additional costs. All changes must be confirmed in writing.

5.4 Refunds

Any refunds will be processed within 14 days after receipt of cancellation or return of equipment.


6. Lessee's Responsibility

6.1 Use of Equipment

The Lessee is obligated to use the equipment responsibly and in accordance with its intended purpose. The equipment shall only be used by the persons registered in the rental agreement.

6.2 Safety Equipment

The Lessee is responsible for using necessary safety equipment, such as helmets and protective gear, when using the rental equipment.

6.3 Inspection upon Receipt

The Lessee is responsible for inspecting the equipment upon receipt. By accepting the equipment, the Lessee confirms that it is in good condition and suitable for its intended use.


7. Insurance and Liability for Damage

7.1 Insurance

  • With Insurance: The Lessee may purchase insurance that covers sudden and unforeseen damages of the equipment. The insurance must be taken out and paid for before the equipment is handed over. Insurance can be purchased in-store, during registration on our computers, via mobile check-in, or through online booking.
  • Without Insurance: If the Lessee does not take out insurance, he/she is fully responsible for all costs related to damage of the equipment.

7.2 Deductibles

With Insurance:

  • Skis:
    • Children/Youth: 500 NOK
    • Beginner/Intermediate: 1,000 NOK
    • Advanced/Advanced Plus/Racing: 1,500 NOK
  • Bicycles:
    • Children: 1,000 NOK
    • Mountain Bikes (Adults/Youth): 1,500 NOK
    • Full Suspension Bikes: 6,000 NOK
    • Electric Mountain Bikes: 6,000 NOK
    • Full Suspension Electric Bikes: 9,000 NOK

Without Insurance (Full Compensation):

The Lessee is responsible for the full value of the equipment in case of loss or total damage if insurance is not taken out. Full compensation applies to the following categories:

  • Skis:
    • Children/Youth: Up to 5,000 NOK
    • Beginner/Intermediate: Up to 8,000 NOK
    • Advanced/Advanced Plus/Racing: Up to 12,000 NOK
  • Bicycles:
    • Children: Up to 10,000 NOK
    • Mountain Bikes (Adults/Youth): Up to 15,000 NOK
    • Full Suspension Bikes: Up to 30,000 NOK
    • Electric Mountain Bikes: Up to 30,000 NOK
    • Full Suspension Electric Bikes: Up to 68,000 NOK

7.3 Exclusions in Insurance

The insurance does not cover damage or loss resulting from:

  • Gross negligence or intentional misconduct by the Lessee, such as riding skis on gravel roads or deliberately damaging the equipment.
  • Violation of safety and theft prevention measures.
  • Damage covered by warranty or other insurance.
  • Theft or damage when the equipment is left unattended or unlocked.
  • Embezzlement, fraud, or illegal appropriation.

8. Theft Prevention Measures

8.1 Securing Equipment

The Lessee is obligated to secure the equipment properly when not in use. The equipment must be stored in a way that prevents theft and damage. The Lessor is not responsible for storing equipment. By agreement, the Lessee may store bicycles with the Lessor, but this does not apply to skis.

8.2 Reporting Theft/Damage

In case of theft or damage, the Lessee must immediately report it to the police and the Lessor and provide a police report when claiming compensation.


9. Delivery and Return of Equipment

9.1 Delivery

The equipment is handed over at the Lessor's premises during store opening hours. The Lessee must present valid identification confirming their identity. This can be the order confirmation with a barcode received via email or other valid ID. For drop-in customers, the Lessor may require valid ID.

9.2 Return

The equipment must be returned at the agreed time and place. Late returns may incur additional rental costs. By agreement, the equipment can be returned at alternative locations.

9.3 Documentation of Equipment Condition

The Lessor must document the condition of the equipment upon return to claim for any damages. The documentation should correspond with the return time according to the Lessor's systems and may include photos and written notes.


10. Limitation of Liability

10.1 Personal Injury and Third-Party Damage

The Lessor is not liable for personal injury or property damage that occurs during the use of the equipment unless it is proven that the equipment was defective upon delivery. The Lessee is responsible for their own actions and must comply with all applicable laws and regulations. By accepting the bicycle at delivery, the Lessee confirms that it is in satisfactory condition for the rental period.

10.2 Indirect Loss

The Lessor is not responsible for indirect losses such as lost profits, loss of data, or other consequential damages.

10.3 Indemnification

The Lessee agrees to indemnify the Lessor for any claims, losses, or expenses, including legal fees, arising from the Lessee's use of the equipment.


11. Complaints and Claims

11.1 Complaints

Any defects in the equipment must be reported to the Lessor immediately. The Lessor will, at their discretion, repair or replace defective equipment.

11.2 Claims Process

Complaints about the rental relationship must be submitted in writing to the Lessor within a reasonable time and no later than 30 days after the end of the rental period. The Lessor aims to resolve any disputes directly with the Lessee.


12. Force Majeure

The Lessor is not liable for failure to fulfill the agreement due to circumstances beyond the Lessor's control (force majeure), including natural disasters, war, pandemics, strikes, or governmental restrictions.

14. Governing Law and Jurisdiction

The agreement is governed by Norwegian law. Any disputes shall be attempted resolved amicably. If this is not successful, the dispute shall be settled by Norwegian courts with the Lessor's place of business as the agreed venue.


15. Changes to Terms

The Lessor reserves the right to change these terms and conditions. Changes will not affect already concluded agreements unless required by law. For long-term rentals (over 30 days, up to a maximum of 60 days), prices and terms can be adjusted by agreement.
