These terms apply between Trysil Skishop Eiendom AS (hereinafter referred to as the "Lessor") and the person or legal entity (hereinafter referred to as the "Renter") who enters into an agreement to hire equipment from the Lessor.

If the Renter orders equipment on behalf of other persons, these are referred to as "Users". The Renter is responsible for ensuring that necessary and correct information about the Users is provided to the Lessor, and for ensuring that the Users are made aware of relevant safety and usage rules.

1. The Lessor

This is a translation for information. In case of discrepancies, the Norwegian version applies.

2. Conclusion of the agreement

2.1 Booking and confirmation

The Renter is responsible for checking that the information in the booking and the booking confirmation is correct, including names, dates, equipment type, sizes and other information relevant to fitting the equipment.

The agreement is binding once the booking has been confirmed by the Lessor.

For bookings requiring full payment in advance, payment must be made in accordance with clause 4.

If, after payment, the Lessor is nevertheless unable to deliver the agreed equipment or a suitable equivalent alternative, the payment for the part of the booking that cannot be delivered will be refunded.

2.2 Acceptance of terms

By completing a booking, the Renter confirms that these rental terms have been made available and accepted.

2.3 Age

The person entering into the rental agreement must, as a general rule, be at least 18 years old. Rentals to minors must be entered into or approved by a parent, guardian or other person with the necessary authority.

3. Definitions

  • First rental day: The first calendar day of the agreed rental period.
  • Rental start: The date and time on which the equipment must be available to the Renter under the agreement.
  • Rental equipment: All equipment hired out by the Lessor, including, among other things, bicycles, skis, snowboards, poles, helmets, bindings and protective equipment.
  • Equipment Protection: A voluntary add-on to the agreement that limits the Renter's financial liability to the Lessor for certain sudden and unintentional damage to the hired equipment, cf. clause 7. Equipment Protection is not insurance.
  • Cancellation fee: A fee deducted from the refund upon cancellation within the period specified in clause 5.1.
  • Night-time: From 23:00 to 06:00.
  • Daytime: From 06:00 to 23:00.
  • Child: Persons up to and including 6 years of age when the term is used for price/equipment categorisation.
  • Youth: Persons from 7 up to and including 17 years of age when the term is used for price/equipment categorisation.

4. Payment

4.1 Terms of payment

Full payment for the rental period must be made at the time of booking unless otherwise agreed in writing. Payment is made in Norwegian kroner (NOK). For payments from abroad, the Renter is responsible for any fees or costs charged to the Renter by their own bank or payment provider.

4.2 Deposit

The Lessor does not normally require a deposit unless otherwise specifically agreed before the rental start. The absence of a deposit does not limit any liability the Renter may have under the rental agreement.

5. Cancellation, changes and no-shows

5.1 Cancellation

The Renter may cancel the booking up until fewer than 3 full calendar days remain before the first rental day. The following rules apply:

"Full days" means full calendar days between the day the Lessor receives the cancellation and the first rental day. The day the cancellation is received and the first rental day are not included.

Example: If the first rental day is a Saturday, the cancellation must be received no later than 23:59 on Tuesday for three full calendar days to remain – Wednesday, Thursday and Friday.

The cancellation fee is calculated once per booking and cannot exceed the amount that would otherwise have been refunded.

5.2 Documented illness and special circumstances

In the case of documented illness, serious unforeseen events or other special circumstances, the Lessor may, following an individual assessment, offer rebooking, a voucher or a full or partial refund beyond what the Renter would otherwise be entitled to. This is a voluntary arrangement and does not mean that the Renter is automatically entitled to such an exception. The Lessor may require reasonable documentation, such as a medical certificate.

5.3 Changes to a booking

Changes to equipment, dates, size or other parts of the booking may be made by agreement with the Lessor and are subject to availability. If the change results in a higher price, the Renter must pay the price difference. If the booking is reduced or the rental period shortened, the reduced part may be treated as a partial cancellation under clause 5.1. All changes must be confirmed by the Lessor.

5.4 Refunds

Approved refunds are processed without undue delay and normally no later than within 14 days after the refund has been approved. The time before the amount appears in the Renter's account may depend on the bank and payment provider. The Lessor may only deduct costs for which there is a legal basis and of which the customer has been informed in advance.

5.5 No-shows and early return

If the Renter fails to show up or chooses to collect the equipment later than agreed, this does not in itself give rise to a right to a refund. Early return of the equipment likewise does not give rise to a right to a refund for unused rental time unless otherwise agreed with the Lessor or required by mandatory law.

5.6 Right of withdrawal for distance sales

For bookings that, under the Norwegian Right of Withdrawal Act (angrerettloven), fall under the exception for services related to leisure activities to be provided on a specific date or within a specific period, the ordinary 14-day right of withdrawal does not apply. The Renter's right to cancel such bookings instead follows from clause 5.1. If a booking or part of a booking is nevertheless covered by a right of withdrawal under mandatory legislation, the provisions of the law take precedence over these terms.

6. Obligations of the Renter and the User

6.1 Use of the equipment

The equipment must be used responsibly and in accordance with its intended purpose. The equipment must only be used by the person or persons registered or approved as Users.

The Renter and User must comply with:

  • the Lessor's instructions
  • the manufacturer's relevant guidance
  • applicable laws and regulations
  • rules and safety instructions in the area where the equipment is used.

The equipment must not be modified, dismantled or rebuilt without the Lessor's consent.

6.2 Safety

The use of skis, bicycles and other sports equipment involves risk. The User is responsible for adapting activity, speed and difficulty level to their own abilities and to weather, snow, track and terrain conditions. Mandatory safety equipment must be used. The Lessor recommends the use of a suitable helmet when cycling and skiing/snowboarding.

6.3 Inspection upon receipt

The Renter must be given the opportunity to inspect the equipment upon receipt. Visible faults or damage discovered by the Renter must be reported to the Lessor as soon as possible and preferably before the equipment is used. Using the equipment does not limit the Renter's rights in respect of hidden faults or defects that could not reasonably have been discovered upon receipt.

6.4 Information and fitting

The Renter must provide correct information when this is necessary for selecting or fitting the equipment, including, for example, height, weight, age, shoe size, skill level, boot length and other relevant information.

Incorrect information may affect the fit and safety of the equipment. Safety-critical settings, including bindings, must not be adjusted by the Renter unless expressly agreed.

7. Equipment Protection and liability for damage

7.1 Optional Equipment Protection

The Renter may choose Equipment Protection as a voluntary addition to the rental agreement. Equipment Protection is not insurance and does not mean that Trysil Skishop Eiendom AS is acting as an insurance company or insurance intermediary.

Equipment Protection means that the Lessor, on the terms set out below, agrees in advance to limit the amount of the financial claim the Lessor may bring against the Renter if the hired equipment is subjected to sudden and unintentional damage for which the Renter would otherwise be liable.

Equipment Protection:

  • must be selected and paid for before the equipment is handed over
  • applies only to the equipment and rental period for which it was purchased
  • does not give any right to a cash payout or other insurance benefit
  • does not cover theft or loss
  • is not refunded because the rental period was completed without damage.

Equipment Protection may be selected in-store, through the Lessor's digital check-in solutions, via mobile check-in, or when booking online.

7.2 Maximum liability for damage with Equipment Protection

If Equipment Protection has been purchased and the conditions are met, the Renter's financial liability for sudden and unintentional damage is limited to the following maximum amounts:

The amounts represent the maximum limit on the Renter's liability for a damage event covered by Equipment Protection. If the Lessor's documented financial loss is lower than the maximum amount, the Lessor cannot claim more than the actual documented loss. Equipment Protection only applies if the Renter would otherwise have been financially liable for the damage under the agreement or general rules of tort/liability law.

7.3 Liability without Equipment Protection

If the Renter has not purchased Equipment Protection, the Renter's ordinary liability under the agreement and general rules of tort/liability law applies.

For repairable damage, the Lessor's financial loss may include, among other things, necessary and reasonable costs for spare parts, repair, necessary labour and other direct costs resulting from the damage.

If the equipment is a total loss or cannot reasonably be repaired, the claim for compensation must be determined based on the equipment's financial value at the time of the damage, taking into account, among other things, age, use, condition and residual value. The Renter shall not pay more than the Lessor's documented financial loss.

The following absolute maximum amounts apply:

The maximum amounts are not standard fees and do not mean that the Renter must automatically pay the stated amount.

7.4 When Equipment Protection does not limit liability

Equipment Protection does not limit the Renter's liability if the damage or loss is caused by:

  • intent or gross negligence
  • deliberate destruction or misuse
  • use for which the equipment is clearly not intended
  • use of skis on gravel, rock or other surfaces without sufficient snow cover, where this is done intentionally or with gross negligence
  • a material breach of the Lessor's safety or usage instructions
  • unauthorised modification or dismantling of the equipment
  • theft
  • loss or failure to return the equipment
  • embezzlement, fraud or other unlawful appropriation
  • the equipment being handed over to an unapproved user in breach of the rental agreement
  • a material breach of the requirements for proper securing or storage.

In such cases, any liability of the Renter is determined in accordance with clause 7.3 and other applicable rules.

7.5 Normal wear and tear and equipment faults

The Renter is not liable for normal wear and tear resulting from normal and reasonable use. The Renter is also not liable for damage or faults caused by a pre-existing defect in the equipment, ordinary material fatigue, a technical failure for which the Renter is not responsible, inadequate maintenance on the part of the Lessor, or circumstances attributable to the Lessor. This applies regardless of whether Equipment Protection has been purchased.

7.6 No insurance benefit

Equipment Protection does not entitle the Renter or the User to any compensation payment from the Lessor, cash settlement, cover for personal injury, cover for damage to third-party property, liability insurance, travel insurance or theft insurance. The arrangement only regulates the size of the claim the Lessor may bring against the Renter for damage to the hired equipment.

8. Theft, loss and securing of equipment

8.1 Securing of equipment

The Renter is responsible for the equipment from the time it is handed over until it has been returned to and received by the Lessor, or placed elsewhere by express agreement. When not in use, the equipment must be secured and stored appropriately based on its type, value and the circumstances. Bicycles must be locked when left unattended if a lock is available or this can reasonably be expected. The Lessor does not normally accept responsibility for storage after the equipment has been handed over. Bicycles may, by special agreement, be stored with the Lessor.

8.2 Theft and loss

Equipment Protection does not limit any liability the Renter may have in the event of theft, loss or failure to return the equipment.

In the event of theft, the Renter must, without undue delay, notify the Lessor and report the matter to the police. The Renter must provide documentation of the police report upon request.

Any claim for compensation must be based on the Lessor's documented financial loss and the equipment's financial value at the time of the loss, within the relevant maximum limits in clause 7.3, unless otherwise required by mandatory law.

8.3 Reporting damage

Damage must be reported to the Lessor as quickly as practically possible. The equipment must not continue to be used if continued use could be unsafe, worsen the damage or cause further damage. The Lessor may request a brief description of the course of events, photographs or other relevant documentation. Ordinary damage does not normally need to be reported to the police.

9. Handover and return

9.1 Handover

The equipment is handed over at the Lessor's premises within applicable opening hours, or at another agreed location and time. The Lessor may ask the Renter for the booking confirmation, QR/barcode, valid identification or other necessary documentation to identify the booking.

9.2 Return

The equipment must be returned to the agreed location no later than the end of the rental period. The Renter is responsible for the equipment until it has actually been returned in accordance with the agreement.

9.3 Late return

In the event of a late return, the Lessor may charge for the additional period the equipment has been in the Renter's possession. If the delay results in a further documented financial loss, the Lessor may claim compensation to the extent the conditions for this are met. The Lessor must take reasonable measures to mitigate its loss.

9.4 Condition documentation

The Lessor may document the condition of the equipment at handover and return by means of, among other things, photographs, video, recorded damage, service status, written notes and identification/serial numbers. Such documentation may be used when assessing damage or claims for compensation.

10. The Lessor's liability

10.1 Delivery of safe equipment

The Lessor must deliver equipment that, at the time of handover, is suitable for the agreed use and in a sound technical condition, subject to normal wear from use that does not affect safety or function.

10.2 Faults during the rental period

If a technical fault occurs for which the Renter is not responsible, the Renter must contact the Lessor as soon as possible. Where practically possible, the Lessor must attempt to repair the equipment, offer suitable replacement equipment, or find another reasonable solution. If the Lessor cannot deliver the agreed service, the Renter may be entitled to a proportionate price reduction or refund for the part of the rental period not delivered.

10.3 Personal injury

The Lessor is not liable for injuries resulting from the Renter's or User's own riding/skiing, choice of risk, or use of the equipment. This does not limit any liability the Lessor has under mandatory Norwegian law, including liability arising from faults in the equipment or negligence for which the Lessor is responsible.

10.4 Third parties

The Renter and User are themselves liable for damage they cause to other persons or others' property through their own use of the equipment, to the extent this follows from applicable law.

10.5 Indirect loss

To the extent permitted by applicable law, the Lessor is not liable for indirect loss or consequential damage. This limitation does not apply where liability cannot lawfully be excluded or limited.

11. Weather, facilities and circumstances beyond the Lessor's control

Hiring of equipment is, in principle, independent of access to lifts, cycling facilities, trails or other external activities. Changes in weather, snow conditions, trail conditions, lift operations or other services provided by third parties therefore do not automatically give rise to a right to a refund if the Lessor is still able to deliver the agreed equipment.

If the Lessor itself is unable to deliver the agreed equipment due to circumstances beyond the Lessor's control, the Renter shall not pay for the part of the rental service that is not delivered. The Lessor may, by agreement, offer alternative equipment, rebooking or a voucher.

12. Force majeure

The Lessor is not liable for compensation for losses caused by extraordinary circumstances beyond the Lessor's reasonable control that the Lessor could not reasonably have foreseen, avoided or overcome the consequences of. This may include, among other things, natural disasters, extreme weather, war or serious security incidents, government orders, extensive power or infrastructure failures, strikes or labour disputes, pandemics and other similar extraordinary events.

Force majeure does not limit the Renter's right to a refund for a service that the Lessor does not actually deliver, if such a refund follows from the agreement or mandatory law.

13. Complaints

13.1 Faults and defects

Faults or defects in the equipment must be reported to the Lessor as soon as possible after the Renter discovers or ought to have discovered the matter. The Lessor must be given a reasonable opportunity to investigate the matter and, where relevant, repair or replace the equipment.

13.2 Complaints

Complaints should be submitted in writing to Trysil Skishop Eiendom AS, e-mail: info@skishop.no. The parties must, as far as possible, attempt to resolve the disagreement directly. If the matter is not resolved, a consumer may use the relevant public complaints or dispute resolution scheme, or bring the matter before the courts.

14. Privacy and communication

14.1 Personal data

The Lessor processes personal data necessary for, among other things, booking, payment, fitting of equipment, handover and return, customer service, documentation of the rental relationship, handling of damage and claims, and compliance with statutory obligations. 14.2 Service communication and marketing

The Lessor may send necessary messages relating to the booking and the rental relationship via e-mail, SMS or other stated contact channel. Marketing is only sent when the Lessor has a valid legal basis for doing so.

15. Governing law and disputes

The agreement is governed by Norwegian law. Any disputes must first be sought resolved amicably between the parties. The provision on Norwegian law and dispute resolution does not limit any mandatory rights a consumer has under applicable legislation, including statutory rules on jurisdiction.

16. Changes to the terms

The Lessor may change the rental terms for future bookings. The version of the terms in effect at the time the agreement was entered into applies to the relevant booking. Changes do not have retroactive effect unless required by law or specifically agreed with the Renter.

17. Long-term rental

For long-term rentals of more than 30 days and up to a maximum of 60 days, special prices, payment terms, liability limits and other conditions may be agreed in writing between the Lessor and the Renter. In the event of conflict between such a special written agreement and these general terms, the special agreement takes precedence, unless otherwise required by mandatory law.
